Terms of Service
1. Introduction
Welcome to Ikasi Agency. These Terms of Service (“Terms”) govern your access to and use of our services, including logo design, corporate identity, website design, e-commerce, and social media marketing and management (the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent that you meet this age requirement and have the legal capacity to enter into binding contracts.
3. Services
Ikasi Agency provides creative services aimed at startups and high-growth businesses in the Africa. The scope of work, deliverables, and timelines will be outlined in individual contracts or agreements with each client. We reserve the right to refuse or discontinue services to anyone at our discretion.
4. Client Responsibilities
Clients must provide accurate and complete information necessary for the completion of services. This includes, but is not limited too, brand guidelines, content, images, and feedback. Any delays caused by the client in providing necessary information or approvals may affect project timelines.
5. Intellectual Property
Upon full payment of services rendered, the client will own the rights to the final deliverables. Ikasi Agency reserves the right to display the work in our portfolio and marketing materials. All concepts, drafts, and materials created during the project but not included in the final deliverables remain the property of Ikasi Agency.
6. Revisions
Clients are entitled to a specified number of revisions as outlined in the project agreement. Additional revisions or changes outside the scope of the original agreement may incur additional fees.
7. Termination
Either party may terminate the agreement for any reason with a written notice. If a project is terminated by the client before completion, Ikasi Agency reserves the right to invoice for work completed up to the termination date.
8. Limitation of Liability
Ikasi Agency will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability will not exceed the amount paid by the client for the specific service in question.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of South Africa.
10. Changes to Terms
Ikasi Agency reserves the right to update or modify these Terms at any time without prior notice. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
